The first thing that comes to mind is an intermitant problem with your clutch switch. I have seen this before. It the clutch switch or wiring is faulty the engine ECU may think you are pushing in the clutch and in turn will not allow the Jakes to work. Next is the accelerator pedal may not be going all the way back to idle.

The Jake Brake doesn't seem to work when in neutral. Teoretically it shoudn't matter wheter the transmission is in gear or not. It should drop the RPMs anyway, provided that neither the clutch nor the accelerator are pressed. I've also read on this forum that in the real word it can be used to make the RPMs drop faster during a gear shift.
